These Terms of Service (“Terms”) govern your use of Beauty Bot, the AI-powered chat assistant operated by The Skin Games LLC (“The Skin Games,” “TSG,” “we,” “us,” or “our”), accessible via Instagram Direct, Facebook Messenger, SMS, and our website.

By sending a message to Beauty Bot, opting into a messaging sequence, or otherwise interacting with our automated chat services, you agree to these Terms. If you do not agree, please do not use Beauty Bot.

Agreement to These Terms

These Terms form a binding agreement between you (“you,” “your,” or “User”) and The Skin Games LLC. By interacting with Beauty Bot in any way — including sending a message, clicking a link, completing a form, or opting into a sequence — you confirm that you have read, understood, and agreed to these Terms.

If you are using Beauty Bot on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

Beauty Bot uses artificial intelligence — specifically large language models — to generate conversational responses. Here is what you should know:

Beauty Bot is an AI, not a human

Responses are generated automatically. While we work to ensure Beauty Bot provides accurate, helpful information, AI responses can be incomplete, outdated, or incorrect. Do not rely on Beauty Bot for medical diagnoses, clinical skincare decisions, or other matters that require a licensed professional’s judgment.

Beauty Bot does not provide professional advice

Content shared by Beauty Bot is for informational and educational purposes only. It does not constitute medical, dermatological, legal, or financial advice. Always consult a qualified professional for decisions affecting your health, your clients’ health, or your business.

AI outputs are not guaranteed

We make no warranty that Beauty Bot’s responses will always be accurate, current, or appropriate for your specific situation. The Skin Games reviews and improves Beauty Bot’s knowledge base on an ongoing basis but cannot guarantee error-free output at all times.

Human oversight

For purchases, event registrations, and other consequential actions, a human team member or a clearly labeled secure checkout process handles the transaction. Beauty Bot does not make binding commitments on behalf of The Skin Games without human confirmation.

Purchases & Enrollments

Beauty Bot may facilitate purchases of products, event registrations, competition entries, or membership enrollments on behalf of The Skin Games. The following terms apply to any transaction initiated through Beauty Bot:

SMS Messaging Terms

If you opt into SMS communications through Beauty Bot — including skincare challenges, product education series, event reminders, or promotional sequences — the following terms apply:

By opting in, you expressly consent to receive recurring automated text messages from The Skin Games at the phone number you provided. Consent is not a condition of any purchase.

Message frequency

Message frequency varies by program. For time-limited sequences (such as a 30-day skincare challenge), you will receive one or more messages per day for the duration of the program. You will be informed of the expected frequency at opt-in.

Message and data rates

Standard message and data rates from your mobile carrier may apply. The Skin Games is not responsible for any charges from your carrier.

Opt-out

You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message and no further messages will be sent, unless you re-opt in. For help, reply HELP or contact us at [email protected].

Supported carriers

Carrier support for SMS programs is not guaranteed. If you experience delivery issues, contact us and we will work to resolve them.

Intellectual Property

All content generated by or associated with Beauty Bot — including chat scripts, educational content, images, product descriptions, program materials, and the Beauty Bot name and branding — is the property of The Skin Games LLC or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any Beauty Bot content without our express written permission. Personal, non-commercial use (such as saving a tip Beauty Bot shared for your own reference) is permitted.

If you submit feedback, suggestions, or ideas about Beauty Bot, you grant The Skin Games a perpetual, royalty-free right to use that input to improve our services, without obligation or compensation to you.

Privacy

Your use of Beauty Bot is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using Beauty Bot, you acknowledge and agree to our Privacy Policy.

In summary: we collect information you share with us during conversations, we use it to provide and improve our services, we do not sell your data, and you can request access, correction, or deletion of your data at any time.

Third-Party Platforms

Beauty Bot operates across platforms owned by third parties, including Meta (Instagram, Facebook Messenger) and Twilio (SMS). Your use of those platforms is subject to their own terms of service and privacy policies, which are separate from these Terms.

We have no control over the policies, availability, or conduct of third-party platforms and are not responsible for any issues arising from their operation. Links or references to third-party products, websites, or services shared by Beauty Bot do not constitute an endorsement by The Skin Games.

Disclaimers

Beauty Bot and all content delivered through it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, The Skin Games makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that:

Limitation of Liability

To the maximum extent permitted by applicable law, The Skin Games LLC, its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of Beauty Bot, including damages for loss of data, loss of revenue, loss of business opportunity, or personal injury.

In no event will our total aggregate liability to you exceed the greater of (a) the amount you paid to The Skin Games in the 12 months preceding the claim, or (b) USD $100.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

Indemnification

You agree to defend, indemnify, and hold harmless The Skin Games LLC and its affiliates, officers, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of Beauty Bot; (b) your violation of these Terms; (c) any content or information you submit through Beauty Bot; or (d) your violation of any third-party rights.

Termination

We may suspend or terminate your access to Beauty Bot at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to our services, our users, or our platform partners.

You may stop using Beauty Bot at any time. To opt out of SMS sequences, reply STOP. To request deletion of your data, contact us at [email protected].

Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.

Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide notice via email, SMS, or through Beauty Bot before the changes take effect. For non-material updates, we will revise the “Last updated” date at the top of this page.

Your continued use of Beauty Bot after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree with updated Terms, please stop using Beauty Bot and opt out of any active messaging sequences.

Governing Law & Disputes

Informal resolution

Binding arbitration

If informal resolution fails, any dispute arising from or related to these Terms or your use of Beauty Bot will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), conducted in [CITY, STATE]. You and The Skin Games each waive the right to a jury trial and the right to participate in a class action.

Small claims

Either party may bring an individual claim in small claims court in lieu of arbitration, where the amount in dispute qualifies.
